Burning  Regulations

For all Counties

Maryland

Forest Fires in Maryland

Maryland’s forest lands are under constant threat of

damage caused by wildfire.  The main causes of wildfire involve

human activities such as: debris burning, arson, equipment

use, and children playing with fire.  Forty two percent of

these fires are a result of improper open-air debris burning.

The Maryland Forest Service is responsible for the control of all

forest fires in the state.  Maryland Forest Rangers supervise

and work together with local Fire Departments to save lives,

property, and forest resources.  Forest Rangers also investigate

forest fires and enforce forest fire laws and regulations.

The following open-air burning regulations apply to activities in

woodland and within 200 feet of woodland, or activities adjacent

to or within an area where flammable materials, that could ignite

and carry fire to woodland, are located.

(These regulations do not apply inside the limits of

incorporated towns.)

These regulations provide for a penalty of up to $500, plus

fire suppression costs if the fire escapes on to a property

of another.

Forest fire protection in Maryland is regulated under Natural Resources

Article, § 5-209 and § 5-604, Annotated Code of Maryland.

A person may not engage in open air burning except

under the following conditions:

There is a natural break or constructed firebreak of at

Least 10 feet wide around the material being

Burned that is free of flammable materials.

(A firebreak is a clear strip, down to bare mineral

soil, around the material to be burned.)

Adequate personnel and equipment are present

to prevent the fire from escaping.

(The individual doing the burning is responsible for

controlling the fire.  Always have sufficient help along

with: water, tools and equipment at the burning

site to control the fire.)

At least one responsible person remains at the

Location of the fire until the last spark is out.

(Individual must be at the burning site continuously
to ensure the fire does not escape.)

Burning occurs between the hours of 4 p.m. and

12 midnight E.S.T. except when the ground

is covered with snow the burning may occur at

anytime so long as all other requirements are met.

(After 4 p.m. there is more moisture in the air,

the temperature drops, and the winds die down.

During Daylight Savings Time, burning hours change
to 5 p.m. to 1 a.m.  These regulations are in effect

year round)

SAFE  BURNING  TIPS

1.    Check the weather; don’t burn on dry, windy days.

2.    Stay with the fire until it is completely out.

Douse hot embers with water.  Embers can

stay hot for days and re-ignite surrounding

  unburned fuel.

3.    Always have sufficient help, water, tools, and

equipment readily available at the burn site to

       control the fire from escaping.

4.     Spring and fall are the seasons of highest fire

danger in Maryland.  Use extra caution during

      these seasons.
